Miller Settlement

A former Elmira police officer who was shot during a training exercise may get a settlement from the city.

The police blame the use of live ammuniton.  I have about 2,000 hours of firearms training under my belt (I do various pistol, carbine and tactics taining over the  course of a year).  And the one thing that is always constant is that a fireram is always loaded.  Strip the slide off, or pull the cylinder (on a revolver) and that bad boy is still lloaded with the most dangerous baby-killing, cop-vest piercing rounds that are available to modern man.

Somebody goofed, we are going to pay.  Hopefully they spend a tiny bit of the 130k sum on more training.

    I have been a New York State Peace Officer for 29 years now and have NEVER seen this type of accident occur during a training exercise or an actual RIOT . During my Military career as an Air Force Security Police Supervisor ( Air Base Ground Defense ) I can also say the same thing. So how does an Elmira Swat member ( the best and the brightest ) shoot a fellow Officer during an exercise ? Whatever it was that transpired we are paying dearly for it in tax dollars. And why are we releasing the Insurance company of $95,000 toward this settlement ? See agenda items

    This is the same Officer Miller who has been on paid suspension for several years now and continues to remain in that status to this day. I also question the reason for this paid vacation and have asked many times why Officer Miller could not be used in an Administrative position to save the Department overtime.
    Officer Miller has the same Lawyer as Bradley had so obviously we will see another payment real soon. And it won’t be in our favor I’m sure….

    Miller had a good lawyer.

    I have seen both accidental discharges and negligent discharges. Both can be cured by more training. Though the one tool that needs the most training is the shooters brain. It controls the rest. His finger did not convulse on the trigger, he did load live ammo in a no-shoot scenario. He was pointing his weapon at something he had no intention of shooting. All cureable, given enough training.

    Also, every live fire exercise I have been privy to, if we were o use simunitions or the like, each student made sure to pay down each and every participant, to ensure there was no live ammo on the range. I mean each student. Training with 6 to 9 guys it could take 20 minutes for everyone to be comfortable. And that is every time yo enter the fun house or shoot house. I never felt like it was time wasted.

    Happens, especially with smaller, less trained departments. EPD does pretty good with what they have though.

    I wouldn’t say 130k is set for life though,maybe for a half a year if he stretches it.

    Are you sure it was the same Miller that was involved in the lawsuit? There are a few of them on the force. I wouldn’t think he would be involved in SWAT training if he was on paid leave.

    I am *not* certain. I only know Scott Drake and Mike Dunham personally, the rest of the EPD crew are not known to me.

    I also know Daryl, the court officer, he and I chat weekly while my daughter is doing her youth court thing. Man, that man knows his motorcycles!

    this is NOT the same miller as the one who is on paid leave. this is his father, joe miller sr. joe miller jr is the one on paid leave. joe miller sr is a good man who served this area for many yrs on the police force. its really crazy that this accident happened i hope this never happens again. hope he has recovered well.

    nina are you freaken kidding me this guy gets shot in the shoulder and you say he has it made because he is getting 130k for it. i saw joe right after he was shot and he was in pretty rough shape, you know that was pretty stupid to say maybe you should go thru what he did and see how much you will have it made!!!

    The shoulder is a rather bad place to get popped. A larger caliber and the hydrostatic shock alone can kill you.

    I would take a .22 in the thigh though for 130k < s >.

    Mahatma, MY BAD!

    I was thinking this was the same Miller who has been on paid leave with full benefits for several years with no end in sight. I was thinking what with the 130K plus all that paid time off plus the huge lawsuit that will probably result if his case is ever settled, that would be what I was talking about when I regretfully said: ‘he has it made’

    In post #10 you explained that these are 2 different individuals. My ‘has it made’ post is #6.

    Obviously I misunderstood because I didn’t have the correct facts.

    I stand corrected and sincerely, deeply apologize and hope you AND Mr. Miller will accept my heartfelt apology.

    I’m the one who owes an apology people. I was under the impression that this was the same Joe Miller that was on paid vacation from the Force. My mistake. But with that said I will add that it seems to be a ‘family’ tradition with the Millers. Anyone remember the Miller who was a Detective and his house was torched by a local by the name of Wandell ? Seems to me that he is a part of the same family. What the heck is going on here ? Sr gets shot at a swat training exercise and Jr. is locked out with full pay ( forever ). Stanley Neu was in that position for years also. The only ones who are truly suffering from all this are the Tax-Payers of Elmira. Get it over with and get on with the job of cleaning this City up…..

    vnvet-Stanley Neu was NOT in the same position for years. He was hurt on the job and was found not to be able to return to work because of the ensuing disability. He was only being paid by Elmira until his retirement went through. For those of you who think it is a scam or whatever for officers who are hurt on the job to be paid for their troubles, you are the ridiculous ones. Even though Neu fell down a flight of stairs while trying to apprehend a criminal, would you think more of him if he were shot instead??? Now he gets to cash in his retirement early, for a smaller amount each month as he did not “earn” enough credits to get the full amount. Sure that sounds great to me, a little over a thousand a month when you were probably making close to $2,000. I do agree, however that Miller Jr. should not be paid for his time off. He was accused of stealing, he was found not guilty. So why are we still paying him?
